Subscription Terms
Effective from February 1, 2026
1. Subscription Plans
kansei.works offers multiple subscription plans with varying features and limits. The available plans, their features, and current pricing are published on the pricing page at kansei.works. The Provider reserves the right to introduce, modify, or discontinue subscription plans. The contractual relationship for paid subscriptions is governed by Section 1751 et seq. of Act No. 89/2012 Sb. (Civil Code). By subscribing to a paid plan, the User enters into a recurring service agreement with koncal studio s.r.o.
2. Free Tier
The Provider offers a free tier of the Service with limited functionality. The free tier is provided without any service level guarantee and may be modified or discontinued at the Provider's discretion with 30 days' advance notice. Free tier users are subject to the same Terms of Service and data protection obligations. The Provider may impose usage limits on the free tier, including limits on the number of entities, invoices, projects, and storage capacity.
3. Pricing and Payment
Paid subscriptions are subject to the following conditions:
- Prices are displayed inclusive of VAT for consumers and exclusive of VAT for business users, in accordance with Act No. 634/1992 Sb. (Consumer Protection Act). The applicable VAT rate is determined by Czech law
- Payment is accepted via international card (Visa, Mastercard) through Stripe and Czech payment methods (bank transfer, card) through GoPay. All payment processing is PCI DSS compliant
- Payment is due at the beginning of each billing cycle (monthly or yearly). The User authorizes recurring charges according to their selected billing cycle
4. Billing Cycle and Renewal
Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled by the User before the renewal date. The renewal date is calculated from the original subscription start date. The User will receive a reminder email at least 7 days before each renewal. By continuing the subscription, the User agrees to the then-current pricing. The billing cycle cannot be changed mid-cycle; a billing cycle change takes effect at the next renewal.
5. Upgrades and Downgrades
Users may upgrade their subscription plan at any time. Upgrades take effect immediately, and the price difference for the remainder of the current billing cycle is prorated. Users may downgrade their subscription plan, with the downgrade taking effect at the start of the next billing cycle. Upon downgrade, features exceeding the limits of the new plan will be restricted but data will not be deleted. The User will be informed of any restrictions that apply to their data upon downgrade.
6. Price Changes
The Provider reserves the right to change subscription prices. Existing subscribers will be notified of price changes at least 30 days before they take effect. Price changes apply from the next billing cycle following the notice period. If the User does not agree with the new pricing, they may cancel their subscription before the price change takes effect, in accordance with the Cancellation Policy. Price increases shall not exceed 20% per year unless due to changes in applicable taxes or regulatory requirements.
7. Taxes and Invoicing
All prices may be subject to applicable taxes, including Czech VAT (DPH) at the rate specified by Act No. 235/2004 Sb. on Value Added Tax. The Provider will issue a tax document (invoice) for each payment in accordance with Czech tax legislation. Invoices are automatically generated and available for download in the User's account. For EU business customers providing a valid VAT ID (DIC), the reverse charge mechanism may apply in accordance with the relevant EU VAT Directive provisions.
8. Suspension for Non-Payment
If a payment fails, the Provider will attempt to charge the payment method on file up to 3 times over a period of 10 days. If payment remains unsuccessful, the subscription will be suspended. During suspension, the User's data is preserved but access to paid features is restricted to read-only mode. If payment is not received within 30 days of suspension, the Provider may downgrade the account to the free tier. The User will be notified by email at each stage of the process.
9. Refund Policy
In accordance with Section 1829 of the Civil Code, consumers who contract at a distance have the right to withdraw from the contract within 14 days of its conclusion without giving a reason. If the consumer has expressly requested that the service begin during the withdrawal period and acknowledges that the right of withdrawal is lost upon full performance, the right of withdrawal may be limited accordingly. Outside the statutory withdrawal period, refunds are generally not provided for subscription fees already paid, except where required by applicable law or in cases of material service failure attributable to the Provider. Annual subscription refund requests will be evaluated on a case-by-case basis.
10. Service Level and Availability
The Provider targets 99.5% uptime availability for the Service, measured on a monthly basis (excluding scheduled maintenance). Scheduled maintenance will be announced at least 24 hours in advance when practicable and will typically be performed during low-traffic hours (CET 02:00-06:00). In the event of downtime exceeding the target in any calendar month, affected paid subscribers may request a service credit proportional to the excess downtime. This does not constitute a legally binding SLA guarantee but represents the Provider's operational commitment. Force majeure events, including natural disasters, governmental actions, and infrastructure-wide outages by third-party providers, are excluded from availability calculations.
